Ross John Henderson’s family says they will seek legal advice should he be cleared in the murder of Jason Afrique and the attempted murder of Afrique’s wife, Micyla.

They said this after Henderson’s  DNA results came back negative.  According to leaked DNA results documents , all the DNA results found on the murder scene can’t be linked to Henderson.

John Ross Henderson (38) is standing accused of the murder of businessman Jason Afrique and the attempted murder of his wife.  Afrique and his wife were shot in their bakkie on the way home in Newpark Kimberley in July 2023.   Jason succumbed to his injuries and his wife survived.   Henderson has been in custody since 20 September 2023.

The family has filed papers in the Supreme Court of Appeal in Bloemfontein after numerous attempts to have him released on bail were rejected in the Kimberley Magistrates’ Court and the Northern Cape High Court, respectively.

Henderson’s father, Ross Kirby Henderson, confirmed that the family is in possession of the DNA that clears his son.

“The DNA results found on the cell phone cover is also inconclusive and can’t be linked to him.  The evidence to date is only speculation.  The forwarded results to us by the prosecutor, the investigating officer, is on record that she is very disappointed with the outcome of the DNA results.  I’m now totally convinced that the police didn’t investigate their case properly  before the arrest.  In fact the police has successfully succeeded to sow division in both families and the community,” said Henderson Snr.

“I have experience of incompetent police investigating officers.  I have seen how suspects have been deprived of their rights.  During my tenure in the legal department of Lawyers for Human Rights, I personally saw what damage incompetent police officers can do in our society at large,” he said.

In their statement Northern Cape SAPS stated:” The SAPS does not release information about evidence in an active investigation that has not been concluded in court.
